These terms apply to raphxagency.com, a website operated by iFansy Limited, a company registered in Hong Kong SAR ("we", "us", "our"). By using this website you accept these terms. If you do not accept them, please do not use the site.

1. What this website is

This website presents information about the marketing services offered by iFansy Limited under the RaphX Agency brand. It does not sell products, it does not process payments, it does not host user accounts, and it does not allow visitors to upload or publish content.

Nothing on this website is an offer in the legal sense. Service descriptions, timelines and ways of working are illustrative. A binding agreement between us exists only once we have agreed scope, price and terms in writing in a separate contract or order.

2. Who may use it

The website is intended for business users. You may use it if you are at least 16 years old. If you contact us on behalf of a company, you confirm that you are authorised to do so.

3. Contacting us through the site

Sending an enquiry creates no obligation on either side. We are not obliged to reply to every enquiry, and we may decline any project. We use the details you send only to respond to you, as described in our Privacy Policy. We do not add enquiries to marketing lists without your consent.

Do not send us confidential material, personal data about third parties, or anything covered by a non disclosure agreement before we have signed one.

4. Our content

All content on this website, including text, layout, design, graphics and the RaphX Agency name and logo, is owned by iFansy Limited or used with permission, and is protected by copyright and trademark law.

You may view the site, print pages for your own reference and link to it. You may not copy substantial parts of the site, republish the content commercially, use our name or logo to suggest a partnership that does not exist, or present our material as your own.

5. Acceptable use

When using this website you agree not to:

• use it for any unlawful purpose or in breach of these terms,
• attempt to gain unauthorised access to the site, its server or any connected system,
• introduce malware or any other harmful code,
• interfere with the availability of the site, for example through automated overload,
• harvest data from the site by automated means beyond ordinary search engine indexing,
• use the contact form to send spam, chain messages or fraudulent offers,
• impersonate another person or organisation.

We may restrict access to the site for anyone who breaches this section.

6. Availability

We aim to keep the website available, but we do not guarantee uninterrupted access. The site may be unavailable during maintenance, or because of failures at our hosting provider or elsewhere on the internet. We may change, suspend or withdraw any part of the website at any time without notice.

Visitors in the EEA and the UK. Where the General Data Protection Regulation applies, you have the right to access your personal data, to have it corrected or erased, to restrict or object to its processing, and to receive it in a portable format. Where we rely on consent, you may withdraw it at any time. You may also complain to your local data protection authority. Requests go to privacy@raphxagency.com.

Residents of California. Where the California Consumer Privacy Act applies, you have the right to know what personal information we collect and why, to request its deletion, and not to be treated differently for exercising these rights. We do not sell or share personal information as those terms are defined by that law, so no opt out mechanism is required.

9. No warranties

This website is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non infringement.

Information on the site is general in nature. It is not marketing, legal, financial or professional advice for your specific circumstances, and you should not act on it without obtaining advice suited to your situation.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, nor for loss of profit, revenue, business, goodwill or data, arising from your use of this website or your inability to use it.

Our total liability in connection with this website is limited to one hundred United States dollars (USD 100). Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Services delivered under a separate signed agreement are governed by the liability provisions of that agreement, not by this section.

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, industrial action, government measures, and failures of power, telecommunications or internet infrastructure.

11. Indemnity

You agree to indemnify us against reasonable claims, damages and costs arising from your unlawful use of this website or your breach of these terms. We will notify you of any such claim and may take control of its defence.

13. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Before starting any formal proceedings, both sides agree to try to resolve the matter informally by contacting the other and allowing 30 days to respond. If the matter is not resolved, the courts of Hong Kong SAR have exclusive jurisdiction. If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory laws of your country of residence.

14. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions stay in force. A delay in enforcing any provision is not a waiver of it. We may transfer our rights and obligations under these terms in connection with a merger, acquisition or sale of assets. You may not transfer yours without our written consent. Nothing in these terms creates a partnership, agency or employment relationship between us. Together with the Privacy Policy and the Cookie Policy, these terms are the entire agreement between us regarding the use of this website.
